1. Acceptance of Terms

By accessing or using Zidividz ("the platform," "we," "us," or "our") at zidividz.com, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years of age to use Zidividz or create an account. Users under 13 are not permitted to use this service.

Purchasing content by users aged 13–17 must be done with the knowledge and consent of a parent or legal guardian. By completing a purchase as a minor, you confirm that a parent or guardian has authorized the transaction.

To receive payouts, you must be at least 18 years of age, as required by PayPal's User Agreement. If you are between 13 and 17, a parent or legal guardian must connect their PayPal account on your behalf and accepts full responsibility for any payout transactions.

Users aged 13–17 must have parental or guardian consent before uploading or selling content on the platform. By uploading content as a minor, you confirm that your parent or legal guardian has reviewed and consented to your use of the platform and the sale of your content.

3. Accounts

You are responsible for the accuracy of your account information, the security of your credentials, and all activity that occurs under your account. You may not share your account or use another person's account without permission.

4. Creator Content and Rights

You retain ownership of content you upload. By uploading content, you grant Zidividz a non-exclusive, worldwide, royalty-free license to host, store, transcode, stream, display, and distribute your content as part of operating the service. You represent that you have all rights necessary to grant this license.

5. Prohibited Content and Conduct

You may not use the platform to:

• Upload, distribute, or transmit unlawful, infringing, or abusive content.
• Engage in fraud, impersonation, or deceptive practices.
• Artificially inflate view counts, use bots, scripts, or other automated means to generate fraudulent engagement or earnings.
• Violate any applicable local, national, or international law or regulation.
• Interfere with platform security, integrity, or other users' experience.

6. Payments, Fees, and Payouts

Payments on Zidividz are processed by PayPal. By making or receiving payments on the platform, you agree to PayPal's User Agreement and applicable PayPal policies.

• Creator payouts are sent to your verified PayPal account. You must connect your PayPal account via "Log in with PayPal" before requesting a payout. Payout requests are subject to a review period and minimum balance threshold.
• Platform fees (commission on video sales and subscriptions) are deducted before payout as described on your earnings dashboard.
• PayPal processing fees may be deducted from payouts unless you are on a Pioneer plan, in which case the platform covers this fee.
• We reserve the right to withhold or delay payouts if we detect fraud, policy violations, or suspicious account activity.

7. Moderation and Enforcement

We may review, limit visibility of, or remove content and suspend or terminate accounts for policy violations, fraud signals, legal compliance requirements, or at our reasonable discretion.

8. Termination

We may suspend or terminate your access at any time for violations of these Terms, legal requests, or security concerns. Upon termination, your right to use the platform ceases immediately. Any earned balance will be reviewed and paid out or forfeited depending on the nature of the termination.

9. Refund and Cancellation Policy

All sales of digital content are final. Because videos and other digital files are delivered immediately upon purchase and cannot be "returned," we do not offer refunds for completed purchases except where required by applicable law.

If you believe a charge was made in error, unauthorized, or fraudulent, contact us at support@zidividz.com within 7 days of the transaction. We will investigate and, where appropriate, coordinate with PayPal to resolve the issue.

Subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused subscription time.

10. Disclaimers and Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties and limit our liability for indirect, incidental, special, or consequential damages arising from your use of the platform.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the platform shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or courts of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.
